According to the update, the deadline for submitting bids remains unchanged—October 19, 2026—but the Tenders Committee will not open the bid box or discuss the submissions prior to November 19, 2026. According to media reports, the change was made following an instruction from the Attorney General, who sought to prevent the tender from being used as election propaganda. She therefore ordered that the opening of the bid box be postponed by a month, so that it will open only after the elections scheduled for October 27, 2026.

Peace Now: “This tender must be canceled. Postponing the opening of the tender box does not change the fundamental fact that the Israeli government is seeking to prevent at all costs the chance for peace based on two-state solution. In fact, even under the new date set for opening the tender box, there is still a strong likelihood that contracts will be signed with contractors before a new government is formed, leaving the incoming government facing a done deal that is far harder to change. Construction in E1 not only destroys the chance for peace, but also poses a real threat to Israel’s economic stability due to economic sanctions that countries around the world intend to impose on anyone involved in the construction.”

The Significance of Postponing the Tender Box Opening

Opening the tender box is the stage at which the Tenders Committee convenes to deliberate on the proposals submitted by participating contractors and select the winners. Immediately thereafter, progress can be made toward signing contracts that grant the winners rights to build on the designated plots. The official notice on the ILA website serves as the first official confirmation of rumors and reports that have circulated in recent weeks across social media and the press, pointing to the following sequence of events:

1. The Attorney General’s First Instruction to Postpone Tender Closing: On September 26, 2026, it was first reported that the Attorney General instructed that the tender closing date—originally set for October 19, 2026—be postponed until after the elections, arguing that the tender could be used for election propaganda. In response to this directive, the Ma’ale Adumim Municipality filed a petition with the High Court of Justice (HCJ) against the Attorney General, demanding the cancellation of her instruction (HCJ 66433-09-26).

2. The Attorney General’s Second Instruction to Postpone Opening the Tender Box: On October 4, 2026, the Attorney General filed her preliminary response to the Ma’ale Adumim petition. According to Peace Now’s assessment (without official knowledge on the matter), the Attorney General announced that instead of postponing the tender closing date, she ordered a delay in opening the tender box. Meaning, bids can be submitted only until October 19, 2026, but will be reviewed only after the elections, following November 19, 2026.

Two days later, on October 6, 2026, Minister Smotrich filed his own petition against the Attorney General’s decision (HCJ 12479-10-26). He rushed to be photographed submitting the petition, defamed the Attorney General, and used the incident as part of his election campaign. The court ruled that the Attorney General must submit her response to this petition by October 14, 2026, along with her response to Ma’ale Adumim’s reply in the second petition.

An official notice regarding the postponement of the box opening date has now been published on the Israel Land Authority website. The notice explicitly mentions that the two petitions on the matter have been filed.

It should be recalled that in October 2025, Peace Now, Ir Amim, Bimkom, and local Palestinian residents filed a petition with the District Court against the approval of the E1 plan. However, although the court has yet to rule on the plan’s approval, the government rushed to publish tenders for its implementation. Following a hearing on the petition last June, the court ruled that the State must respond to the petitioners’ claims by September 2026. Since then, the State has requested several extensions and today requested an additional extension to submit its response by October 19, 2026.

Concurrently, and independently of the Attorney General’s instructions, Peace Now appealed to the Ministry of Housing and the Israel Land Authority, demanding that they publish a warning on the tender website stating that anyone participating in it could be subject to international sanctions.

The Israel Land Authority (ILA) published an update on Thursday regarding the details of the tender for the construction of 1,234 housing units in E1.
