They removed equipment and structures, destroyed crops, and installed a fence. Work continued in the following days. The municipality cited \u201cgardening orders\u201d that allow it to take control of land for landscaping. In a statement published online, the Greek Orthodox Patriarchate said:<\/p>\n<\/div>\n<p dir=\"ltr\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-58037 aligncenter\" src=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Patriarchate_Statement_170626.png\" alt=\"\" width=\"577\" height=\"500\" srcset=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Patriarchate_Statement_170626.png 577w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Patriarchate_Statement_170626-161x140.png 161w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Patriarchate_Statement_170626-330x286.png 330w\" sizes=\"auto, (max-width: 577px) 100vw, 577px\" \/><\/p>\n<blockquote>\n<div dir=\"ltr\" style=\"text-align: left;\">Peace Now:<\/div>\n<div dir=\"ltr\">&#8220;Jerusalem is a city of profound importance to three religions and to billions of people around the world. The State of Israel should serve as a model of governance that respects all faiths and affords dignity to all of Jerusalem\u2019s residents. Instead, in recent years, Israeli authorities have increasingly pushed the city\u2019s non-Jewish presence aside, not only Palestinians, but also Christians.<\/div>\n<div dir=\"ltr\">The takeover of Church land in Silwan is part of a broader effort, led by settler organizations, to gain control over the entire Wadi Rababa and Silwan area and transform it from a Palestinian space into an Israeli one. The Jerusalem Municipality and the Israel Nature and Parks Authority have become instruments of the settler ideological agenda.&#8221;<\/div>\n<\/blockquote>\n<div dir=\"ltr\">The Greek Orthodox Patriarchate has filed an urgent lawsuit against the Jerusalem Municipality, seeking an injunction to stop the work and compensation for damages to Church property.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\" style=\"text-align: left;\">A hearing was held on Thursday at the Jerusalem Magistrate\u2019s Court. The municipality argued that it was acting under the municipal <a href=\"https:\/\/www.nevo.co.il\/law_html\/law01\/mek_003_006.htm\">bylaw Maintaining Order and Cleanliness<\/a> (Section 39), which authorizes the mayor to order the removal of obstructions from the street.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\" style=\"text-align: left;\">The municipality further argued that a \u201cgardening order\u201d was issued for the parcel in January 2025, allowing it to take control of neglected land to carry out landscaping work. It should be noted that <a href=\"https:\/\/www.haaretz.co.il\/news\/local\/2022-08-28\/ty-article\/.premium\/00000182-e0ab-dc3e-abf7-e0bfac1f0000\">similar gardening orders have been issued in recent years for about 200 dunams<\/a> (50 acres) of land in the Wadi Rababa (Ben Hinnom Valley) area of Silwan.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-58043\" src=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Greek-Orthodox-Land-Silwan-ENG.jpg\" alt=\"\" width=\"1344\" height=\"1014\" srcset=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Greek-Orthodox-Land-Silwan-ENG.jpg 1344w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Greek-Orthodox-Land-Silwan-ENG-161x121.jpg 161w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Greek-Orthodox-Land-Silwan-ENG-330x249.jpg 330w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/Greek-Orthodox-Land-Silwan-ENG-768x579.jpg 768w\" sizes=\"auto, (max-width: 1344px) 100vw, 1344px\" \/><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\" style=\"text-align: left;\">\n<p>During the hearing, the Secretary General of the Greek Orthodox Patriarchate, Bishop Aristarchos, testified:<\/p>\n<\/div>\n<blockquote>\n<p dir=\"ltr\">\u201cWe were surprised by the municipality\u2019s conduct. It did not notify us in advance or attempt to engage with us. We are interested in reaching an understanding with the municipality in a way that does not harm us or the municipality\u2019s plans.\u201d<\/p>\n<p dir=\"ltr\">\n<\/blockquote>\n<div dir=\"ltr\" style=\"text-align: left;\">The judge asked if the municipality would enter discussions with the Patriarchate. The municipality\u2019s representative declined, stating it does not recognize the Patriarchate\u2019s ownership. The municipality argued that since the land was not cultivated, it is considered state land under the law.<\/div>\n<div dir=\"ltr\" style=\"text-align: left;\">\n<p>In response, Bishop Aristarchos said:<\/p>\n<\/div>\n<blockquote dir=\"ltr\"><p>\u201cI am astonished by the municipality\u2019s position. Everyone knows this is Church land, and it is important to us for religious and archaeological reasons. In the past, we cooperated with the municipality. In the 1970s, we carried out archaeological excavations on the site in full coordination with the municipality.\u201d<\/p>\n<div id=\"attachment_58039\" style=\"width: 1252px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-58039\" class=\"wp-image-58039 size-full\" src=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2026\/06\/The_Bishop1.jpg\" alt=\"\" width=\"1242\" height=\"2560\" data-wp-editing=\"1\" \/><p id=\"caption-attachment-58039\" class=\"wp-caption-text\">Bishop Aristarchos at the Court, June 18, 2026<\/p><\/div><\/blockquote>\n<div dir=\"ltr\" style=\"text-align: left;\">\n<p>A representative of the Israel Nature and Parks Authority explained that the municipality\u2019s actions were essential to protecting the land and its antiquities from encroachment and damage. He added that, in order to protect the land,<\/p>\n<\/div>\n<blockquote dir=\"ltr\"><p>\u201cI need to have my foot on the ground and take care of the site.
