{"id":45428,"date":"2025-11-19T14:58:45","date_gmt":"2025-11-19T11:58:45","guid":{"rendered":"https:\/\/peacenow.org.il\/?p=45428"},"modified":"2025-11-20T20:49:27","modified_gmt":"2025-11-20T17:49:27","slug":"civil-administration-announces-intent-to-seize-approximately-1800-dunams-at-the-sebastia-archaeological-site","status":"publish","type":"post","link":"https:\/\/peacenow.org.il\/en\/civil-administration-announces-intent-to-seize-approximately-1800-dunams-at-the-sebastia-archaeological-site","title":{"rendered":"Civil Administration Announces Intent to Seize Approximately 1,800 Dunams at the Sebastia Archaeological Site"},"content":{"rendered":"<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The Civil Administration has <a href=\"https:\/\/www.gov.il\/he\/pages\/archaeological_site\">announced its intention<\/a> to seize roughly 1,800 dunams at the archaeological site of Sebastia \u2014 the largest land appropriation for antiquities ever recorded, adjacent to the village homes and to Area B, and affecting thousands of dunams of privately owned olive groves.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\"> In a public notice, the authority said it plans to expropriate the Sebastia archaeological site for development and <\/span><span data-preserver-spaces=\"true\">to prepare it<\/span><span data-preserver-spaces=\"true\"> for public visits. The move is highly unusual, both because of the site\u2019s location and because it <\/span><span data-preserver-spaces=\"true\">is carried out<\/span><span data-preserver-spaces=\"true\"> under an administrative order for antiquities.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The plan would seize nearly 1,800 dunams belonging to the Palestinian villages of Burqa and Sebastia, including thousands of olive trees. <\/span><span data-preserver-spaces=\"true\">The land is privately owned and registered in the land registry <\/span><span data-preserver-spaces=\"true\">by<\/span><span data-preserver-spaces=\"true\"> Palestinian owners<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> Residents and landowners have <\/span><span data-preserver-spaces=\"true\">been given<\/span><span data-preserver-spaces=\"true\"> 14 days to file objections to prevent the order from taking effect. The government has also allocated more than <a href=\"https:\/\/peacenow.org.il\/en\/the-civil-administration-begins-archaeological-excavations-at-the-sebastia-site\">30 million shekels<\/a> for developing the Sebastia site.<\/span><\/p>\n<blockquote>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">Peace Now: \u201cThe Israeli government\u2019s drive for dispossession and annexation knows no limits, and it is prepared to violate international law openly to pursue it. This is part of a broader effort to take control and expand settlements in areas northwest of Nablus that Israel evacuated during the disengagement. Sebastia is a heritage site located inside a Palestinian village, part of its history and part of a future Palestinian state. Under the Oslo Accords, signed by Israel, it should have been transferred to Palestinian administration long ago. Israeli greed harms not only the landowners, but also the prospect of a peaceful solution that upholds the rights and heritage of both peoples.\u201d<\/span><\/p>\n<p dir=\"ltr\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-45429\" src=\"http:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM.jpeg\" alt=\"\" width=\"1600\" height=\"1131\" srcset=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM.jpeg 1600w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM-161x114.jpeg 161w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM-330x233.jpeg 330w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM-150x105.jpeg 150w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM-768x543.jpeg 768w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/11\/WhatsApp-Image-2025-11-19-at-11.56.07-AM-1536x1086.jpeg 1536w\" sizes=\"auto, (max-width: 1600px) 100vw, 1600px\" \/><\/p>\n<\/blockquote>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">Land expropriations for antiquities development have been carried out in the West Bank, to the best of our knowledge, five times since 1967:<\/span><\/p>\n<ul>\n<li dir=\"ltr\" style=\"text-align: left;\"><strong><span data-preserver-spaces=\"true\">1982:<\/span><\/strong><span data-preserver-spaces=\"true\"> Two dunams <\/span><span data-preserver-spaces=\"true\">were taken<\/span><span data-preserver-spaces=\"true\"> at the ancient synagogue in Jericho.<\/span><\/li>\n<li dir=\"ltr\" style=\"text-align: left;\"><strong><span data-preserver-spaces=\"true\">1985:<\/span><\/strong><span data-preserver-spaces=\"true\"> 286 dunams <\/span><span data-preserver-spaces=\"true\">were taken<\/span><span data-preserver-spaces=\"true\"> from the <a href=\"https:\/\/www.keremnavot.org\/_files\/ugd\/a76eb4_4df6acda312f432c8b88a447d59fb897.pdf\">village of Susya<\/a> in the South Hebron Hills, <\/span><span data-preserver-spaces=\"true\">its residents were expelled<\/span><span data-preserver-spaces=\"true\">, and <\/span><span data-preserver-spaces=\"true\">the site was later placed<\/span><span data-preserver-spaces=\"true\"> under the Hebron Hills Regional Council. Palestinians may enter only by paying the Israel Nature and Parks Authority.<\/span><\/li>\n<li dir=\"ltr\" style=\"text-align: left;\"><strong><span data-preserver-spaces=\"true\">2020:<\/span><\/strong><span data-preserver-spaces=\"true\"> About 24 dunams <\/span><span data-preserver-spaces=\"true\">were expropriated<\/span><span data-preserver-spaces=\"true\"> at the Deir Qal\u2019a and Deir Samaan sites.<\/span><\/li>\n<li dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">\u00a0<\/span><strong><span data-preserver-spaces=\"true\">February 2023:<\/span><\/strong><span data-preserver-spaces=\"true\"> 139 dunams <\/span><span data-preserver-spaces=\"true\">were taken<\/span><span data-preserver-spaces=\"true\"> at the Archelais site in the Jordan Valley.<\/span><\/li>\n<\/ul>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\"> In the cases of <a href=\"https:\/\/www.keremnavot.org\/post\/%D7%AA%D7%99%D7%A7%D7%95%D7%9F-%D7%98%D7%A2%D7%95%D7%AA\">Deir Qal\u2019a and Deir Samaan<\/a>, the sites now lie inside the settlements of Alei Zahav and Peduel, and Palestinians have no access to them.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">In all cases, the expropriations <\/span><span data-preserver-spaces=\"true\">were formally defined<\/span><span data-preserver-spaces=\"true\"> as serving a public purpose, but in <\/span><span data-preserver-spaces=\"true\">practice,<\/span><span data-preserver-spaces=\"true\"> they led to the exclusion of Palestinians from the sites. Under international law governing occupied territories, public-purpose expropriations <\/span><span data-preserver-spaces=\"true\">are permitted<\/span><span data-preserver-spaces=\"true\"> only when they serve the needs of the local population.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The Sebastia case is especially unusual because the expropriation targets an archaeological site that has long served as an economic, cultural, and tourism anchor for residents of Sebastia and the surrounding area, and that has been open to the public. <\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">Around the site are souvenir shops and restaurants, and in Sebastia <\/span><span data-preserver-spaces=\"true\">itself,<\/span><span data-preserver-spaces=\"true\"> many residents earn their living from guiding visitors and renting rooms to tourists. The Sebastia site lies inside the village, among residents\u2019 homes. The expropriation concerns the western part of the site, an area with fewer homes and surrounded by olive groves.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The scope of the expropriation is <\/span><span data-preserver-spaces=\"true\">exceptionally large<\/span><span data-preserver-spaces=\"true\">. To develop the site, authorities approved the seizure of 1,800 dunams. Until now, the largest expropriation for antiquities was in Susya, involving 286 dunams. Although most of the Sebastia area slated for expropriation has <\/span><span data-preserver-spaces=\"true\">been designated<\/span><span data-preserver-spaces=\"true\"> as archaeological land, the part of the site that visitors currently tour covers only about 60 dunams.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The expropriation notice follows earlier government steps regarding Sebastia. In 2023, the Israeli government <a href=\"https:\/\/peacenow.org.il\/en\/the-government-will-vote-on-sunday-7-5-23-to-develop-the-sebastiya-archeological-site-located-adjacent-to-the-palestinian-village-of-sebastiya\">approved a 32-million-shekel<\/a> plan to develop the site, and in <\/span><span data-preserver-spaces=\"true\">2025,<\/span><span data-preserver-spaces=\"true\"> the Civil Administration <a href=\"https:\/\/peacenow.org.il\/en\/the-civil-administration-begins-archaeological-excavations-at-the-sebastia-site\">began archaeological excavations<\/a> there.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\"> A short distance from the ancient site is the Mas\u2019udiya (Sebastia) railway station, where the government<a href=\"https:\/\/peacenow.org.il\/en\/renovation-of-the-masoudiasebastiya-train-station-as-a-touristic-settlement-in-the-north-of-the-west-bank\"> has <\/a><\/span><span data-preserver-spaces=\"true\">begun<\/span><span data-preserver-spaces=\"true\"> building a tourism settlement. Using tourism for settlement purposes is not new<\/span><span data-preserver-spaces=\"true\">, but in<\/span><span data-preserver-spaces=\"true\"> the northern West <\/span><span data-preserver-spaces=\"true\">Bank,<\/span><span data-preserver-spaces=\"true\"> it appears to be part of <\/span><span data-preserver-spaces=\"true\">wider<\/span><span data-preserver-spaces=\"true\"> development plans that include <a href=\"https:\/\/peacenow.org.il\/en\/cabinet-decision-22-settlements\">establishing the Homesh and Sa-Nur<\/a> settlements and linking tourism with settlement expansion.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">International law permits land expropriation in occupied territory only when it serves the needs of the occupied population. In the case of Sebastia, it is unclear how the expropriation would benefit Palestinians. The development would ease access for Israelis and, at the same time, exclude Palestinians from their land and from the archaeological site.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><span data-preserver-spaces=\"true\">The Sebastia site is identified with the capital of the biblical Kingdom of Israel,<\/span><span data-preserver-spaces=\"true\">\u00a0known as Samaria. It contains remains of the city built by Herod in the first century BCE in honor of Augustus, after whom he named it Sebastia. <\/span><span data-preserver-spaces=\"true\">The site includes striking remains from the Kingdom of Israel, the Roman, Byzantine, <\/span><span data-preserver-spaces=\"true\">and<\/span><span data-preserver-spaces=\"true\"> Crusader <\/span><span data-preserver-spaces=\"true\">periods,<\/span> <span data-preserver-spaces=\"true\">and<\/span> <span data-preserver-spaces=\"true\">others<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Civil Administration has announced its intention to seize roughly 1,800 dunams at the archaeological site of Sebastia \u2014 the largest land appropriation for antiquities ever recorded, adjacent to the village homes and to Area B, and affecting thousands of dunams of privately owned olive groves.
