{"id":44563,"date":"2025-09-03T14:18:51","date_gmt":"2025-09-03T11:18:51","guid":{"rendered":"https:\/\/peacenow.org.il\/?p=44563"},"modified":"2025-09-03T14:32:45","modified_gmt":"2025-09-03T11:32:45","slug":"havat-gilad-declaration","status":"publish","type":"post","link":"https:\/\/peacenow.org.il\/en\/havat-gilad-declaration","title":{"rendered":"The Civil Administration Declared 456 dunams West of Nablus as State Lands"},"content":{"rendered":"<p dir=\"ltr\">Yesterday, the Custodian of Government Property in the Civil Administration <a href=\"http:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-Gilad-Declaration-010925.pdf\" target=\"_blank\" rel=\"noopener\">declared 455.58 dunams<\/a> (113 acres) of land belonging to the villages of Tell, Jit, and Far&#8217;ata, west of Nablus, as &#8220;state land,&#8221; for the purpose of legalizing the illegal outpost of <a href=\"https:\/\/peacenow.org.il\/en\/israel-must-not-authorize-havat-gilad-outpost\" target=\"_blank\" rel=\"noopener\">Havat Gilad<\/a>. Most of the declared land is located about one kilometer south of the existing houses in the outpost. This means that it is not a \u201clegalization\u201d of the outpost but rather preparation for establishing another settlement south of it.<\/p>\n<p dir=\"ltr\" data-start=\"814\" data-end=\"1339\">Since the current government was formed in December 2022,\u00a0<a href=\"https:\/\/peacenow.org.il\/en\/state-land-declaration-12000-dunams\" target=\"_blank\" rel=\"noopener\">around 25,959 dunams<\/a>\u00a0have been declared state land\u00a0\u2014 <strong>amounting to nearly half of all land ever declared state land since the Oslo Accords<\/strong>. Declaring land as state land is one of the main tools Israel uses\u00a0<a href=\"https:\/\/peacenow.org.il\/en\/what-is-a-declaration-of-state-land\" target=\"_blank\" rel=\"noopener\">to take control of land<\/a> in the occupied territories. Land declared as state land is allocated almost <a href=\"https:\/\/peacenow.org.il\/en\/state-land-allocation-west-bank-israelis\" target=\"_blank\" rel=\"noopener\">exclusively to Israelis<\/a>.<\/p>\n<p dir=\"ltr\" data-start=\"1341\" data-end=\"1779\"><strong data-start=\"1341\" data-end=\"1425\">During the 1980s, Israel declared hundreds of thousands of dunams as state land.<\/strong>\u00a0In 1992, the Rabin government decided to halt such declarations, but the Netanyahu government resumed the practice in 1998. Over the past two years, there has been a sharp increase in the amount of land declared as state land, and the government plans to issue more declarations to enable the establishment of new settlements\u00a0<a href=\"https:\/\/peacenow.org.il\/en\/cabinet-decision-22-settlements\" target=\"_blank\" rel=\"noopener\">as approved by the cabinet<\/a>.<\/p>\n<blockquote>\n<p dir=\"ltr\" data-start=\"1781\" data-end=\"2599\"><strong data-start=\"1781\" data-end=\"1805\">Peace Now:<\/strong> \u201cIt is not a &#8220;legalization&#8221; of an outpost but rather the establishment of a new settlement one kilometer away of it. Netanyahu and Smotrich are determined to fight against the whole world and against the interests of Israeli citizens in favor of a handful of settlers who receive thousands of dunams as a gift \u2014 as if there is no political conflict to resolve or war to end. Today, it is clear to everyone that this conflict cannot be resolved without a political agreement that includes the establishment of a Palestinian state in the West Bank and Gaza, yet the Israeli government chooses instead to make peace more difficult and push us further away from ending the bloodshed&#8221;.<\/p>\n<\/blockquote>\n<div id=\"attachment_44555\" style=\"width: 1260px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-44555\" class=\"wp-image-44555\" src=\"http:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925.jpg\" alt=\"\" width=\"1250\" height=\"1405\" srcset=\"https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925.jpg 1529w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925-143x161.jpg 143w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925-330x371.jpg 330w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925-768x863.jpg 768w, https:\/\/peacenow.org.il\/wp-content\/uploads\/2025\/09\/Havat-gilad-declaration-010925-1366x1536.jpg 1366w\" sizes=\"auto, (max-width: 1250px) 100vw, 1250px\" \/><p id=\"caption-attachment-44555\" class=\"wp-caption-text\">The lands declared as &#8220;State Land&#8221; in blue. Most of the houses of the outpost are located on private land and not on the declared lands.<\/p><\/div>\n<p dir=\"ltr\" data-start=\"108\" data-end=\"180\"><strong data-start=\"108\" data-end=\"178\">The Declaration: Not \u201cLegalization\u201d but a New Settlement<\/strong><\/p>\n<p dir=\"ltr\" data-start=\"182\" data-end=\"539\">The outpost of Havat Gilad, established in 2002 on private land, was evacuated several times by the army in its early years, but later became a permanent fact on the ground. Today dozens of families live in the outpost. On February 4, 2018, following the murder of Rabbi Raziel Shevach near the outpost, the Netanyahu government <a href=\"https:\/\/www.gov.il\/BlobFolder\/reports\/seder_gov010218\/he\/n568.pdf\" target=\"_blank\" rel=\"noopener\">decided to legalize the outpost<\/a>.<\/p>\n<p dir=\"ltr\" data-start=\"541\" data-end=\"1356\">In the years since, settlers attempted to claim they had purchased the land from Palestinian owners, but they failed to prove ownership, and therefore the outpost <a href=\"https:\/\/peacenow.org.il\/en\/israel-must-not-authorize-havat-gilad-outpost\" target=\"_blank\" rel=\"noopener\">was not legalized<\/a>. Now, after staff work carried out by <a href=\"https:\/\/peacenow.org.il\/en\/annexation-under-the-radar-the-establishment-of-the-settlements-administration-under-minister-bezalel-smotrich-report\" target=\"_blank\" rel=\"noopener\">the Settlement Administration<\/a> established by the government under Minister Smotrich, the state has declared land about one kilometer south of the outpost as \u201cstate land\u201d for the purpose of \u201clegalizing\u201d it. However, the declared lands show that the vast majority of the outpost\u2019s houses are built on private land and therefore cannot be legalized. To make the outpost \u201clegal\u201d according to Israel\u2019s own rules (all settlements are illegal under international law), the existing houses would have to be demolished and the outpost rebuilt elsewhere, about a kilometer away from its current location.<\/p>\n<p dir=\"ltr\" data-start=\"1358\" data-end=\"2371\">It is already clear, however, that in practice <strong>no buildings will be demolished<\/strong>; instead, new construction will simply be added on the declared land. For decades the government has allowed the outpost to continue to seize private land and has refrained from removing the settlers. It is hard to believe that now, as it promotes formal \u201cregularization,\u201d it will suddenly demolish homes.<\/p>\n<p dir=\"ltr\" data-start=\"1358\" data-end=\"2371\">This is exactly what happened in the case of the <a href=\"https:\/\/peacenow.org.il\/en\/nativ-haavot-file-english\" target=\"_blank\" rel=\"noopener\">Nativ Ha\u2019avot outpost<\/a>, which was built on private land west of Bethlehem. The landowners petitioned the High Court of Justice, and the state committed before the Court that it would conduct a land survey after which the houses that will be found built on private land would be removed. In practice, after the survey and the declaration on state land, <a href=\"https:\/\/peacenow.org.il\/en\/the-government-is-seeking-to-confiscate-private-palestinian-lands-for-a-settlement-2\" target=\"_blank\" rel=\"noopener\">the government refused<\/a> to remove those houses, and only after another High Court petition and a <a href=\"https:\/\/peacenow.org.il\/en\/nativ-haavot-file-english\" target=\"_blank\" rel=\"noopener\">long political struggle<\/a> were the structures finally evacuated. The settlers, however, <a href=\"https:\/\/peacenow.org.il\/en\/special-update-evictions-nativ-haavot\" target=\"_blank\" rel=\"noopener\">received personal compensation<\/a> and a <a href=\"https:\/\/peacenow.org.il\/en\/a-new-settlement-without-the-world-noticing\" target=\"_blank\" rel=\"noopener\">construction plan for hundreds of housing units<\/a> on the lands added to the outpost.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yesterday, the Custodian of Government Property in the Civil Administration declared 455.58 dunams (113 acres) of land belonging to the villages of Tell, Jit, and Far&#8217;ata, west of Nablus, as &#8220;state land,&#8221; for the purpose of legalizing the illegal outpost of Havat Gilad.
